Finally,
the Hindu Muslim dispute that had been in the court for over last 70 years was
settled on Saturday i.e is on 9th Nov 2019
by a bench of five judges of Supreme Court. The verdict was handed over for construction of Ram temple on the disputed
land. The supreme court also allocated 5
acres at a prominent place in Ayodhya for construction of a Mosque. As per
verdict 2.77 acre disputed land was given to Deity Lord Ram.
It
had all started when Mir Baki, a commander of Mughal Emperor Babar constructed
a mosque in Ayodhya about four centuries back. During British
rule in year 1856-57, the British administration divided the worship area by
putting railing in between inner and outer area of the mosque. The reason for
this division was the dispute between Hindu and Muslims who often quarrelled
over the place worship area. Muslim said, it is a mosque, whereas Hindu said,
the structure has been built over a Hindu Mandir after destroying the same. As
per arrangement made by Britishers, Muslim used the inner portion of mosque while
Hindu used the outer portion for worship.
On
January 29th, 1885 a man named Mahanth Raghubar Das files a suit to construct
a temple at Ram chabutra of the disputed structure. The then District judge
named dismissed it. In 1934 during Hindu Muslim riots, the dome of the structure
at disputed site was destryed. The same was then repaired by Britishers.
On
23rd December 1949, Idols were found inside
the central dome of the mosque which was probably done by Hindus. On January 16, 1950, Gopal Singh Visharad
file a suit in independent India in the case. One Mr. Gopal Visharad filed a
suit for the right to pray and conduct pooja in the inner courtyard. The court
allowed puja.
Since
independence till 1986, numerous suits were filed by Hindu and Muslims for the
claim of the structure. In year 1986, an advocate filed a suit for opening of
gates of the structure for darshan by general public. The matter went to court
and court allowed the gate to be opened for darshan by Hindus. The court ruling
was challenged by Muslim group. The matter gradually took political turn and finally
the structure was demolished by a group of Hindus on 6th December 1992. This
led to widespread riots in country.
The
matter went to Allahabad High Court, but the order of High court was cagain challenged
in supreme court. Court ordered to maintain the same status at the disputed
site.
On
8 January this year, the SC set up a five-judge bench to hear the title suit in
Ayodhya. In February this year, Chief Justice of India Ranjan Gogoi formed a
five-judge bench under him, along with Justice Ashok Bhushan, Justice Nazeer,
Justice Bobde and Justice Chandrachud. The bench proposed a court-monitored
mediation by former SC Judge Justice FM Kalifulla, Sri Sri Ravi Shankar and
senior advocate Sriram Panchu who were in the mediation panel. The mediation
began on March 13 at Awadh University in Faizabad. Seven rounds of discussion
took place but it didn’t yield results.
On
August 2, the court decided to start regular hearing from August 6. The apex
court heard the case regularly for 40 days and in the last 11 days one extra
hour was given for parties to complete their hearing.
Finally,
on 09.11.19, the bench of five supreme court judge, announced the verdict for
construction of Grand Ram temple at 2.77 Acre disputed land and 5 acre land was
also given to Muslim Waqf board for construction of a grand Mosque. The court
condemned in strongest words that destroying public place of worship in 1992
was an unlawful act.
Court
while announcing the verdict also said that the judgement for construction of Ram
Temple is based on better evidences placed by Hindus before the court.
